WTO Faults Argentina Over Rules Tied To Tax Transparency

Law360, New York (October 1, 2015, 9:34 PM ET) -- A World Trade Organization panel ruled Wednesday that Argentina ran afoul of international agreements in its implementation of tax and investment policies disfavoring nations that refuse to share tax information, but the panel stopped short of declaring that fiscal transparency cannot justify differing treatment.

Ruling on a dispute initiated by Panama in 2012, the panel found that some of Argentina’s actions were inconsistent with the General Agreement on Trade in Services because they discriminated against what the country considered “non-cooperative jurisdictions” for purposes of fiscal information...
